Acknowledgment of Risk

I, the undersigned participant, acknowledge that playing tennis and being present on the property involves inherent risks, including but not limited to physical injury, illness, or death. I understand these risks and voluntarily assume full responsibility for any harm that may occur.

Release and Waiver

In consideration of being allowed to enter and use the property and facilities, I hereby release, waive, discharge, and hold harmless Gary and Heather Carmell, their heirs, agents, employees, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur while on the property, whether caused by negligence or otherwise.

Indemnification

I agree to indemnify and defend Gary and Heather Carmell against any claims, damages, or expenses (including attorney’s fees)arising from my actions or presence on the property.

Medical Treatment

I consent to receive medical treatment deemed necessary in the event of injury or illness while on the property and agree to be responsible for all associated costs.

Severability

If any provision of this waiver is found unenforceable, the remaining provisions shall remain in full force and effect.
